How Many Motorcycle Accidents are there in Florida?

Motorcycle accidents in Florida are now twice what they used to be 20 years ago. Although, in 2015, we experienced a decline in the figure as there were 584 records of motorcycle accidents in Florida. However, the average record of motorcycle accidents in Florida remains at 550 fatalities per year – from 2016 to 2021. In addition, the overall road accidents in Florida have increased by approximately 17% in the last five years, and motorcycle accidents by 3%.

Only 3% of the registered motor vehicles in Florida are motorcycles, which contribute less than a percent to the Vehicle Miles Travelled (VMT) on Florida roadways. More so, motorcycle crashes account for only 2% of road accidents in Florida in the last five years.

Despite the low figures for motorcycle crashes, there seems to be an unreasonable number of fatal cases involving deaths. From 2016 till date, about 17% of deaths resulting from road accidents are from motorcycle crashes.

From 2015 to 2020, the highest motorcycle accidents involving fatal injuries were recorded during spring and fall. In other words, fatal cases were common in March, April, and October. March also recorded the most cases of motorcycle fatalities, and November and December represented successive high points.

When further broken down, this survey shows us that these accidents were common on weekends and weekdays, having only a low frequency. It further revealed that Saturday had the highest cases of motorcycle fatalities, followed by Sunday and Friday.

Florida Motorcycle Laws

Florida is infamous for having no legislation governing motorcycle safety. Florida has minimal laws requiring motorcycle riders to wear helmets, despite data demonstrating a considerable reduction in the risk of traumatic brain injury.

All motorcycle riders under the age of 21 must wear a helmet. Motorcycle drivers have the right to use public roads and are required to abide by all traffic regulations.

In addition, the state permits adults to ride without protective headgear with one crucial proviso: a motorcycle rider who wants to do so must be covered by an insurance policy that provides at least $10,000 in medical coverage.

In Florida, wearing safety eyewear is a requirement for all motorcyclists who are operating their vehicles on public roads. It is a legal requirement for motorcycles to always have working headlights and mirrors. The motorcycle must have a dedicated passenger seat and footrests if the rider is transporting a passenger.

Motorcycle Accident Compensation

The basis for determining compensation for a Florida motorcycle accident claim is the same as it is for any other personal injury claim: compensation must be proportionate to the harm. However, how you evaluate the damage can vary greatly and is heavily influenced by the knowledge and expertise of your motorbike accident lawyer.

A motorbike collision is frequently the fault of another motorist. If this occurs, you are entitled to compensation from that driver’s insurance. In some cases, another person may be responsible for the collision, for example, if the bike’s manufacturer sold you a faulty or unsafe model.

Your attorney will identify who is at blame and present a case for liability. Additionally, they will compute the overall cost of all accident-related damages. An objective for accident compensation is accomplished in this way.

You are entitled to both monetary and non-monetary compensation if you suffered injuries in a motorbike accident in Florida. The first is for charges or expenses that are monetary, whereas the second is a type of payment for harms that cannot be quantified. The following are typical damages that a lawyer can assist you in pursuing:

Your eligibility for damages depends on the specifics of your accident and the supporting documentation.

  • Medical bills
  • Ambulance bills
  • Therapists
  • Prescription drugs
  • Lost wages and benefits
  • Pain and suffering
  • Emotional anguish
  • Loss of companionship
  • Diminished quality of life
  • Embarrassment or disfigurement

The amount of damages that an injured victim may get may be capped in some areas. The compensation value you can obtain is not legally constrained, which is good news for Florida motorcycle accident victims. Neither of the aforementioned forms of compensation has an upper limit.
