  • Comparative Negligence: Florida is a pure comparative negligence state. For example, if a court finds a person 20% responsible for their accident, their awarded damages will be reduced by 20%.
  • Burden of Proof for Business Properties: For accidents that occur on business properties, the injured party must prove the business had actual or constructive knowledge of the hazardous condition and should have taken action to fix it. Constructive knowledge can be proven by showing:
  • The condition existed for so long that the business should have known about it through the exercise of ordinary care, or
  • The condition occurred with regularity and was therefore foreseeable.
  • Reporting the Incident: It’s important to report a slip and fall on a business property as soon as possible. This provides documentation and ensures the incident is recorded in a timely manner which can be crucial to the case.
  • Statute of Limitations: 4 years. If you don’t file within that time you lose your case.

  • Statute of Limitations: The statute of limitations to file a wrongful death claim in Florida is generally 2 years from the date of death. This is a hard deadline, and if you don’t file within this time, you will likely lose your right to compensation.
